By using digitalservicesnb.ca (this "Site") or engaging Digital Services NB ("we", "us", "our") for website design, hosting, or maintenance services, you agree to these Terms of Service. If you do not agree, please do not use the Site or our services.
This Site and its content are provided for the purpose of informing you about our services and enabling you to contact us. You agree not to misuse the Site, including attempting to disrupt its operation or access it through unauthorized means.
We offer custom website design (one-time project packages), managed hosting, ongoing maintenance ("Website Care" monthly plans), local SEO and Google Business Profile setup, and bilingual website builds, as described on our Services and Pricing pages. The specific scope, deliverables, timeline, and price for any project will be confirmed with you directly before work begins.
Website design packages are one-time project fees; Website Care plans are billed monthly with no long-term contract and may be cancelled with 30 days' notice, as described on our Pricing page. Additional pages, revisions beyond what's included in your package, and third-party costs (domains, premium plugins, paid software) are quoted and billed separately.
Once a website project is delivered and paid in full, you own the content, design assets, and code produced for you — we do not hold your site hostage or require ongoing payment for you to keep or move it. Until a project is paid in full, all work product remains our property. We retain the right to display completed projects in our own portfolio and marketing unless you request otherwise.
You are responsible for providing timely content, feedback, and approvals needed to complete your project, and for ensuring that any content, images, or materials you supply do not infringe on the rights of others. We are not liable for delays caused by late client input.
Our services and this Site are provided "as is." While we take reasonable care in our work, we do not guarantee that any website will be error-free, uninterrupted, or achieve any particular business outcome (such as search ranking or sales results).
To the maximum extent permitted by law, Digital Services NB is not liable for any indirect, incidental, or consequential damages arising from your use of this Site or our services. Our total liability for any claim relating to our services is limited to the amount you paid us for the services giving rise to the claim.
This Site may link to or rely on third-party services (such as our font provider) that we do not control and are not responsible for.
These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable therein.
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated terms.
